India Cracks Down On Unauthorized Use Of Patent Office Logo

The Department for Promotion of Industry and Internal Trade (DPIIT) has issued a public notice stating that prior approval from the Ministry of Commerce and Industry is required for the use of the official logo of the Indian Patent Office. This move aims to prevent the misuse of the logo, which can create a false impression of official government endorsement.
The Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM) has noticed that various individuals and entities are unlawfully using the official logo of the Indian Patent Office. The unauthorized use of the logo can lead to civil and criminal prosecution, as it is an offence under the Emblems and Names (Prevention of Improper Use) Act, 1950, the Trade Marks Act, 1999, the Copyright Act, 1957, and the Information Technology Act, 2000.
Entities and individuals currently displaying the IPO logo or deceptively similar designs are required to remove such materials. Non-compliance with the notice can attract immediate civil and criminal prosecution, administrative sanctions, and reporting to law enforcement authorities without further notice.
